Tehy brings the Kätilöopisto Maternity Hospital damages case to the Supreme Court

Today, on 2 December 2025, Tehy, a trade union for the healthcare, social welfare and early childhood education and care sectors, has submitted an application for leave to appeal to the Supreme Court. The leave to appeal concerns a judgment of the Helsinki Court of Appeal, in which the court dismissed the claims for damages brought by three former employees of the Kätilöopisto Maternity Hospital (HUS) regarding illness caused by poor indoor air quality at the workplace.

The decision issued by the Helsinki Court of Appeal on 3 October 2025 overturned an earlier judgment of the Helsinki District Court, which ordered HUS to pay compensation to the former employees for health problems and illness caused by poor indoor air quality at the workplace. 

The Helsinki Court of Appeal agreed with the District Court that there was a causal link between the conditions at Kätilöopisto, particularly the water and microbial damage discovered in the hospital, and the symptoms of the employees.

However, the Court of Appeal found that HUS had acted diligently as an employer and had taken care of the claimants’ safety at work in accordance with the Occupational Safety and Health Act and the Employment Contracts Act. Therefore, the Court of Appeal judged that there were no grounds for granting the claims for damages.

Next, the Supreme Court will consider the application for leave to appeal.
